Payment for research participation has raised ethical concerns, especially with respect to its potential for coercion. We argue that characterising payment for research participation as coercive is misguided, because offers of benefit cannot constitute coercion. In this article we analyse the concept of coercion, refute mistaken conceptions of coercion and explain why the offer of payment for research participation is never coercive but in some cases may produce undue inducement.

This book examines the birth of the scientific understanding of motion. It investigates which logical tools and methodological principles had to be in place to give a consistent account of motion, and which mathematical notions were introduced to gain control over conceptual problems of motion. It shows how the idea of motion raised two fundamental problems in the 5th and 4th century BCE: bringing together being and non-being, and bringing together time and space. The first problem leads to the exclusion (...) of motion from the realm of rational investigation in Parmenides, the second to Zeno's paradoxes of motion. Methodological and logical developments reacting to these puzzles are shown to be present implicitly in the atomists, and explicitly in Plato who also employs mathematical structures to make motion intelligible. Univocalist analyses of the modal auxiliary verbs ('ought'/'must'/'can') and the adjective 'right'/'wrong'.

This study proposes that Moses’ agape and storge love of his people was the motivation for his adoption of fatherly leadership style. The study relies on a direct reading of Hebrew language version of the relevant books of the Old Testament. We provide examples that anchor Moses fatherly leadership style in biblical texts, and reference it to modern leadership thoughts and practical wisdom. Moses’ traits, such as humility, gratitude, forgiveness, and altruism, and his unparalleled grit provided him with the capabilities (...) required to perform as a father leader. This leadership style is characterized by availability (awareness), building community, commitment to the growth of people, disciplining, foresight, healing, involvement, listening, persuasion, providing, relinquishing control, role modeling, showing empathy, stewardship (serving), supporting, and teaching. We provide leaders with a list of fatherly leadership behaviors that lacks the authoritarian component of eastern paternalistic leadership style, and that may be well practiced in the health care, social work, education, sport management and other people service industries. What I call ‘the standard view’ claims that IRBs should not regard financial payment as a benefit to subjects for the purpose of risk/benefit assessment. Although the standard view is universally accepted, there is little defense of that view in the canonical documents of research ethics or the scholarly literature. This paper claims that insofar as IRBs should be concerned with the interests and autonomy of research subjects, they should reject the standard view and adopt ‘the incorporation view.’ The incorporation (...) view is more consistent with the underlying soft-paternalist justification for risk-benefit assessment and demonstrates respect for the autonomy of prospective subjects. Adoption of the standard view precludes protocols that advance the interests of subjects, investigators, and society. After considering several objections to the argument, I consider several arguments for the standard view that do not appeal to the interests and autonomy of research subjects. (shrink)

Our culture is conflicted about morally judging and condemning. We can't avoid it altogether, yet many layfolk today are loathe to do it for reasons neither they nor philosophers well understand. Their resistance is often confused (by themselves and by theorists) with some species of antiobjectivism. But unlike a nonobjectivist, most people think that (a) for us to judge and condemn is generally (objectively) morally wrong , yet (b) for God to do so is (objectively) proper, and (c) so too (...) for certain persons in certain relations (e.g., self-condemnation, parental child rearing.) Certainly, religious (e.g., Christian) critics of judging and condemning without doubting the objective truth of their tradition's core moral teachings. Most puzzling is that (a) merely judging and condemning in one's heart may be improper, and (b) someone else with no more evidence or expertise might properly judge and condemn the same action. The answer is in condemning's complex structure of presuppostions. Condemning and judging are acts, and attitudes initiated by the act. Condemnation is motivated by two judgments presumed to justify it, a criticism of a target, and a judgment that the criticism justifies some negative response toward the target. Unlike nonpunitive penalties, punishments are motivated and explained by condemnation. Condemnation is an act of a hostile will, wishing some evil for its target, not (just) as a means to some good. Its root is in damning, an act akin to cursing. It declares a degraded status. The hostility makes it harder to justify condemnation than criticism, and punishment than nonpunitive penalties. Condemning claims objectivity and authority. It involves reflexive evaluation, regarding itself justified, approving its hostile feelings toward the target. Condemners presume themselves entitled to sit in judgment, pass judgment, and cast the condemned down. Those presumptions inhere in sitting in judgment, assuming jurisdiction. Unlike mathematical or scientific judgments, passing moral judgment seems to be a political act subject to extraepistemic constraints. "Who are you to judge?" may properly challenge your right to pass judgment. (shrink)

John McMillan's article raises numerous important points about the ethics of surgical castration of sex offenders.1 In this commentary, we focus solely on and argue against the claim that the offer of release from detention conditional upon surgical castration is a coercive offer that compromises the validity of the offender's consent. We take no view on the question as to whether castration for sex offenders is ethically permissible. But, we reject the claim that it is ethically permissible only if competing (...) ethical considerations outweigh worries about coercion. For in the situation described, the proposal is not coercive at all.McMillan states that if offenders agree to castration because they fear long-term detention, then ‘it seems, intuitively, as if agreeing to be castrated under these conditions makes the decision coerced in some way.’1 He adds that if castration is ‘the only way that they will be released back into the community, the status of this decision as a genuine expression of their autonomy is questionable.’1 In defence of his claim, he uses two analogies that he borrows from Joel Feinberg. First, if a governor offers to commute a death sentence if the prisoner agrees to participate in a medical experiment, then ‘it's clear that the governor is coercing the prisoner.’1 Second, if a millionaire offers to give a woman $1 000 000 …. There is a good deal of biomedical research that does not produce scientifically useful data because it fails to recruit a sufficient number of subjects. This fact is typically not disclosed to prospective subjects. In general, the guidance about consent concerns the information required to make intelligent self-interested decisions and ignores some of the information required for intelligent altruistic decisions. Bioethics has worried about the ‘therapeutic misconception’, but has ignored the ‘completion misconception’. This article argues that, other things being equal, (...) prospective subjects should be informed about the possibility of non-completion as part of the standard consent process if it is or should be anticipatable that there is a non-trivial possibility of non-completion and that information is likely to be relevant to a prospective subject's decision to consent. The article then considers several objections to the argument, including the objection that disclosing non-completion information would make recruitment even more difficult. (shrink)

This article contains an analysis of the concept of hospitality as defined in the thinking of Jacques Derrida, who applies the concept of an unsolvable aporia. Thinking about the ethics of hospitality takes place between the right hospitality described by Kant, and the decision to open up to the Other, revealing the infinite hospitality of ethics. Questions posed by Derrida result from a combination of two different traditions of thought: first, how to reconcile Kantian universal law with the particularity of (...) political thinking, and second, how to introduce unconditional hospitality into a project of global governance. The author traces the efforts made to intersect the Kantian universalism with Lévinas’s ethical vision. She also analyses how this hospitality may refer to the political practice that is governed by general laws. (shrink)

This article has two broad purposes. First, as a political philosopher who has been interested in the concepts of coercion and exploitation, I want to consider just what the analysis of the concept of consent can bring to the question, what sexually motivated behavior should be prohibited through the criminal law? Put simply, I shall argue that conceptual analysis will be of little help. Second, and with somewhat fewer professional credentials, I shall offer some thoughts about the substantive question itself. Among other things, I will argue that it is a mistake to think that sexual crimes are about violence rather than sex and that we need to understand just why the violation of sexual autonomy is a serious wrong. I shall also argue that the principle that “no means no” does not tell us when “yes means yes,” and that it is the latter question that poses the most interesting theoretical difficulties about coercion, misrepresentation, and competence. In addition, I shall make some brief remarks concerning two questions about consent and sexual relations that lie beyond the criminal law: What “consent compromising behaviors” should be regarded as indecent, although not criminal? We describe and analyze 13 cases handled by our ethics consultation service (ECS) in which families requested continuation of physiological support for loved ones after death by neurological criteria (DNC) had been declared. These ethics consultations took place between 2005 and 2013. Patients’ ages ranged from 14 to 85. Continued mechanical ventilation was the focal intervention sought by all families. The ECS’s advice and recommendations generally promoted “reasonable accommodation” of the requests, balancing compassion for grieving families with other ethical and (...) moral concerns such as stewardship of resources, professional integrity, and moral distress. In cases we characterized as finitegoal accommodation, a “reasonable accommodation” strategy proved effective in balancing stakeholders’ interests and goals, enabling steady progress toward resolution. When a family objected outright to a declaration of DNC and asked for an indefinite accommodation, the “reasonable accommodation” approach offered clinicians little practical direction, and resolution required definitive action by either the family or the clinical team. Based on our analysis and reflections on these 13 cases, we propose ethically justified and practical guidelines to assist healthcare professionals, administrators, and ECSs faced with similar cases. Utility of this conception exhibited in resolving puzzles regarding ontology, truth, and fatalism.

The right to withdraw from participation in research is recognized in virtually all national and international guidelines for research on human subjects. It is therefore surprising that there has been little justification for that right in the literature. We argue that the right to withdraw should protect research participants from information imbalance, inability to hedge, inherent uncertainty, and untoward bodily invasion, and it serves to bolster public trust in the research enterprise. Some maintain that voluntariness is a value-neutral concept. On that view, someone acts involuntarily if subject to a controlling influence or has no acceptable alternatives. I argue that a value-neutral conception of voluntariness cannot explain when and why consent is invalid and that we need a moralized account of voluntariness. On that view, most concerns about the voluntariness of consent to participate in research are not well founded.

Contra Michael Walzer and Jeff McMahan, neither classical just war theory nor the contemporary rules of war require or support any notion of combatant moral equality. Nations rightly accept prohibitions against punishing enemy combatants without recognizing any legal or moral right of aggressors to kill. The notion of combatant moral equality has real import only in our interpersonal -- and intrapersonal -- attitudes, since the notion effectively preempts any ground for conscientious objection. Walzer is criticized for over-emphasizing our collective responses (...) to war conduct and slighting our personal, extra-political responses. (shrink)

Policy makers are understandably interested—for both political and moral reasons—in following Thaler and Sunstein's recommendation to use ‘choice architecture’ , or other ‘nudges’, to promote desirable behaviour in ways that are allegedly compatible with personal freedom.1 Yashar Saghai's intricate analysis shows that simply maintaining the target's choice-set is insufficient to preserve the target's freedom when the nudge bypasses the target's deliberative capacities—as it is specifically designed to do.2 In his friendly amendment to Thaler and Sunstein's project, Saghai advances a more (...) robust account of nudges in which fewer policies would count as nudges, but those that do count as nudges would be less troublesome. In this commentary, I briefly discuss several issues raised by Saghai's project, some of which go beyond the topic of nudges. How important is definitional salvaging? If a ‘substantially controlling’ influence were more efficacious in promoting healthy behaviours, we would have a trade-off between the efficacy of a policy and its compatibility with freedom. Saghai states that an influence can be morally permissible even if it is ‘substantially controlling’ and, therefore, does not qualify as a nudge. So even on Saghai's definitional project it is not clear how much work it does in distinguishing the morally permissible from the morally impermissible. The …. (shrink)

Analyses of quotation have assumed that quotations are referring expressions while disagreeing over details. That assumption is unnecessary and unacceptable in its implications. It entails a quasi-Parmenidean impossibility of meaningfully denying the meaningfulness or referential function of anything uttered, for it implies that: 'Kqxf' is not a meaningful expression 'The' is not a referring expression are, if meaningful, false. It also implies that ill formed constructions like: 'The' is 'the' are well formed tautologies. Such sentences make apparent the need for (...) what is commonly explicit, a genuine referring expression, a noun phrase, usually a description, to which the quotation is appositional. A quotation is not itself a word, though it may contain such. The markers signal that the enquoted material is like a sentence-embedded color patch, material displayed to facilitate reference to something identifiable by/with it specified by the noun phrase it subserves. Recent military coups in West Africa have put the continent’s democratisation itself into question. In some places, for the moment, these coups appear to have popular backing. Nigeria, where radicalism is firmly rooted in democratic values and a human-rights framework, the radical grassroots opposition to the Buhari government’s creeping authoritarianism lies drenched in blood. The roots of this development go back to the history of Nigeria’s radicalism in the twentieth century. Much has appeared on the global 1968 recently, including that (...) of Africa. 1970s/1980s-style radicalism is reappearing today with Omoyele Sowore’s 2018 presidential candidacy, with the African Action Congress party, the #EndSARS protests and the tragic Lekki Toll Gate massacre (2020) in Nigeria. The shift towards radicalism is palpable with protest music such as Falz’s This is Nigeria, and Burna Boy’s Monsters you Made, both explicitly targeting neocolonialism and police brutality. Contrary to Achille Mbembe’s sweeping dismissal of African radicalism, the movement with very deep roots under study is meaningful once again, and is gathering momentum in West Africa’s giant polity. This article applies Walter Benjamin’s and also Nigerian radical thinkers’ conceptualisation of political, social and artistic radicalism, while it frames the Nigerian version via the movement’s history, in which marxisant theory and praxis, feminism, human rights and pro-democracy movements interact with emancipatory strands of Islam, Christianity, Igbo Judaism, and animism. In the context of Nigerian radicalism, even expressly pro-capitalist art theory performs a radical social function by stressing the African’s right to make universal statements (Olu Oguibe) in its de facto defiance of the neo-colony. As these different strands of protest meet, ethnic uprisings (amongst them IPOB) find ways to establish common cause with social radicalism, posing a composite threat to the prebendalist oligarchy that rules and oppresses the country via a militarised neoliberalism. Recreational Drugs European Network (ReDNet) project aims to use the Psychonaut Web Mapping Project database (Psychonaut Web Mapping Group, 2009) containing novel psychoactive compounds usually not mentioned in the scientific literature and thus unknown to clinicians as a unique source of information. The database will be used to develop an integrated ICT prevention approach targeted at vulnerable individuals and focused on novel synthetic and herbal compounds and combinations. Particular care will be taken in keeping the health professionals working directly with (...) young people showing problematic behaviors regularly updated in terms of novel compounds and combinations as well. A user-friendly project website will be developed aimed primarily at delivering the information/prevention approaches, but will also be a way of communicating with project partners and relevant stakeholders (e.g. thematic forum facilities, instant messages, blogs, video chat, wikiblog, newsletters distributed via mailing list). The website will support various ICT prevention tools, including an SMS alert service. Different areas and sections will be aimed specifically at the different target groups. -/- . (shrink)

Especially where a patient's ability to communicate is limited, the receptive use of art visually offers an entry point into contemplation and insight. Here, receptive work with visual art can help to dissolve limitations in verbal communication. In receptive art therapy, an independent therapeutic resource is attributed to the artistic work and its symbolic pictorial content, which can initiate a healing process. A form of indirect communication is stimulated, in which not only a change on the symbolic but also on (...) the emotional level takes place through the emotionally highly charged pictorial-symbolic expression in the confrontation. Different approaches and basic concepts of the method are presented. This conference volume is addressed to the patients, therapists and clinical as well as inclusive companions in these processes. These mixed ancestries also come with different social expectations. In the social-political world of Native Studies where I walk daily, my French grandmother, mamere, is argued as coming from a world of privilege because she was white-skinned, and my Cree grandmother, nokum is thought to come (...) from a world of oppression because she was dark-skinned. Yet both my grandmothers experienced abuse and prejudice. How and where the abuses originated may be different, but they did occur. I have a lot to learn from my grandmothers, but it has taken me many years of inner conflict, self-righteousness, and pain to get to this understanding. To acknowledge both grandmothers having been oppressed means I cannot continue to think of the world in simplistic, binary terms of colonizer/colonized. I must legitimize the equality of suffering in both cultures. Indeed, my worldviews had been turned upside down as I began to identify with the feminist movement, nonetheless it is nokum's world that was shattered, demeaned, and distorted, so it is her world I bring to you today with this story. Another day I may talk about my mamere's patriarchal world, but today is for nokum. (shrink)

Responding to increasing global anxiety over the ethics education of military personnel, this volume illustrates the depth, rigour and critical acuity of Professional Military Ethics Education (PMEE) with contributions by distinguished ethical theorists. It refreshes our thinking about the axioms of just war orthodoxy, the intellectual and political history of just war theorizing, and the justice of recent military doctrines and ventures. The volume also explores a neglected moral dimension of warfare, jus ante bellum (the ethics of pre-war practices) – (...) particularly jus in disciplina bellica (the ethics of educating for warfare). Within the relevant semantics and pragmatics literature the terms “presupposition” and “conventional implicature” are used in a variety of different, but frequently overlapping, ways. The overlaps are perhaps not surprising, given that the two categories of conveyed meaning share the property of remaining constant in the scope of other operators—the property usefully characterize as projectivity. One of my purposes in this paper will be to try to clarify these different usages. In addition to that we will explore two additional properties (...) which are shared by some of these projective contents—strong contextual felicity, and neutralizability.
